Više od deset godina splitski policajac pokušava sudskim putem doći do svojih neplaćenih prekovremenih sati što ih je odradio još 2010. godine. Zbog dugova je 2013. tužio državu, ali do danas taj postupak nije okončan, piše N1.

Ustavni sud RH dao je sada Općinskom sudu u Splitu rok od šest mjeseci da donese presudu. Policajcu je pak dosudio naknadu od 1.500 eura zbog provrijeđenog prava na suđenje u razumnom roku.

Ovaj slučaj je u ovih više od deset godina prošao sve sudske instance – od Općinskog suda u Splitu, preko Županijskog suda u Splitu, do Vrhovnog suda RH. Nakon sedam održanih ročišta, te financijskog vještačenja Općinski sud u Splitu donio je u kolovozu 2014. presudu u policajčevu korist.

Sud je utvrdio da je policajac, koji radi u pomorskoj policiji, od veljače do prosinca 2010. u redovnom i prekovremenom radu na terenu bio angažiran 24 sata dnevno. Zato je ocijenjeno da mu pripada pravo na naknadu za prekovremeni rad u skladu sa Zakonom o policiji i Kolektivnim ugovorom za državne službenike i namještenike.

Država se na to žalila, no presudom u rujnu 2014. Županijski sud u Splitu žalbu odbija i potvrđuje presudu u korist policajca. Naknadno će uslijediti obrat.

Republika Hrvatska traži reviziju od Vrhovnog suda RH koji ukida presude nižih sudova i sve vraća na početak, na ponovno suđenje.

Nije životno prihvatljiv

Prema stajalištu Vrhovnog suda nižestupanjski sudovi su pogriješili jer nisu utvrdili koliko je točno sati prekovremeno radio ovaj policajac. Naime, u jednoj od svojih ranijih odluka već su zaključili da “prekovremeni rad od 24 sata dnevno tijekom rada na terenu nije životno prihvatljiv”.

Zato po stavu Vrhovnog suda RH, nije moguće da je svaki rad dulji od 40 sati tjedno prekovremeni rad. Niži sudovi nisu utvrdili stvarno odrađene prekovremene sata za koje je policajac morao biti plaćen. To je moralo biti utvrđeno u ponovljenom postupku.

Novo suđenje krenulo je početkom 2017. godine. Ispitano je nekoliko svjedoka koje je predložio policajac da bi zatim sve bilo prekinuto jer je zaključeno da Županijski sud u Splitu mora zauzeti stav u svim ovakvim slučajevima kakvih je na tom sudu bilo više.

Tek prije nekoliko dana donijeto je rješenje o nastavku procesa.

Policajac je u međuvremenu zbog sporosti suđenja podnio ustavnu tužbu. 

Ustavni sud zaključio je da je gotovo 11 godina sudovanja doista neopravdano iako slučaj nije jednostavan.

“Ustavni sud ocjenjuje da je trajanjem radnog spora u navedenom mjerodavnom razdoblju podnositelju ustavne tužbe povrijeđeno pravo da sud u razumnom roku odluči o njegovim pravima i obvezama što je zajamčeno Ustavom”, navedeno je u presudi Ustavnog suda, piše N1.

Više od deset godina splitski policajac pokušava sudskim putem doći do svojih neplaćenih prekovremenih sati što ih je odradio još 2010. godine. Zbog dugova je 2013. tužio državu, ali do danas taj postupak nije okončan, piše N1.

Ustavni sud RH dao je sada Općinskom sudu u Splitu rok od šest mjeseci da donese presudu. Policajcu je pak dosudio naknadu od 1.500 eura zbog provrijeđenog prava na suđenje u razumnom roku.

Ovaj slučaj je u ovih više od deset godina prošao sve sudske instance – od Općinskog suda u Splitu, preko Županijskog suda u Splitu, do Vrhovnog suda RH. Nakon sedam održanih ročišta, te financijskog vještačenja Općinski sud u Splitu donio je u kolovozu 2014. presudu u policajčevu korist.

Sud je utvrdio da je policajac, koji radi u pomorskoj policiji, od veljače do prosinca 2010. u redovnom i prekovremenom radu na terenu bio angažiran 24 sata dnevno. Zato je ocijenjeno da mu pripada pravo na naknadu za prekovremeni rad u skladu sa Zakonom o policiji i Kolektivnim ugovorom za državne službenike i namještenike.

Država se na to žalila, no presudom u rujnu 2014. Županijski sud u Splitu žalbu odbija i potvrđuje presudu u korist policajca. Naknadno će uslijediti obrat.

Republika Hrvatska traži reviziju od Vrhovnog suda RH koji ukida presude nižih sudova i sve vraća na početak, na ponovno suđenje.

Nije životno prihvatljiv

Prema stajalištu Vrhovnog suda nižestupanjski sudovi su pogriješili jer nisu utvrdili koliko je točno sati prekovremeno radio ovaj policajac. Naime, u jednoj od svojih ranijih odluka već su zaključili da “prekovremeni rad od 24 sata dnevno tijekom rada na terenu nije životno prihvatljiv”.

Zato po stavu Vrhovnog suda RH, nije moguće da je svaki rad dulji od 40 sati tjedno prekovremeni rad. Niži sudovi nisu utvrdili stvarno odrađene prekovremene sata za koje je policajac morao biti plaćen. To je moralo biti utvrđeno u ponovljenom postupku.

Novo suđenje krenulo je početkom 2017. godine. Ispitano je nekoliko svjedoka koje je predložio policajac da bi zatim sve bilo prekinuto jer je zaključeno da Županijski sud u Splitu mora zauzeti stav u svim ovakvim slučajevima kakvih je na tom sudu bilo više.

Tek prije nekoliko dana donijeto je rješenje o nastavku procesa.

Policajac je u međuvremenu zbog sporosti suđenja podnio ustavnu tužbu. 

Ustavni sud zaključio je da je gotovo 11 godina sudovanja doista neopravdano iako slučaj nije jednostavan.

“Ustavni sud ocjenjuje da je trajanjem radnog spora u navedenom mjerodavnom razdoblju podnositelju ustavne tužbe povrijeđeno pravo da sud u razumnom roku odluči o njegovim pravima i obvezama što je zajamčeno Ustavom”, navedeno je u presudi Ustavnog suda, piše N1.

Više od deset godina splitski policajac pokušava sudskim putem doći do svojih neplaćenih prekovremenih sati što ih je odradio još 2010. godine. Zbog dugova je 2013. tužio državu, ali do danas taj postupak nije okončan, piše N1.

Ustavni sud RH dao je sada Općinskom sudu u Splitu rok od šest mjeseci da donese presudu. Policajcu je pak dosudio naknadu od 1.500 eura zbog provrijeđenog prava na suđenje u razumnom roku.

Ovaj slučaj je u ovih više od deset godina prošao sve sudske instance – od Općinskog suda u Splitu, preko Županijskog suda u Splitu, do Vrhovnog suda RH. Nakon sedam održanih ročišta, te financijskog vještačenja Općinski sud u Splitu donio je u kolovozu 2014. presudu u policajčevu korist.

Sud je utvrdio da je policajac, koji radi u pomorskoj policiji, od veljače do prosinca 2010. u redovnom i prekovremenom radu na terenu bio angažiran 24 sata dnevno. Zato je ocijenjeno da mu pripada pravo na naknadu za prekovremeni rad u skladu sa Zakonom o policiji i Kolektivnim ugovorom za državne službenike i namještenike.

Država se na to žalila, no presudom u rujnu 2014. Županijski sud u Splitu žalbu odbija i potvrđuje presudu u korist policajca. Naknadno će uslijediti obrat.
